Terms and conditions

Article 1

All purchase and sales agreements are governed exclusively by the terms and conditions stated below. Any deviation from these terms is valid only once and only after written confirmation.

Article 2

  1. Orders accepted by us are binding for delivery within the specified period; however, we are never liable for the consequences of exceeding this period. Exceeding the deadline does not entitle the buyer to cancel the order or claim compensation.
  2. Call-off orders that are not fully called off within the agreed term give us the right to send the remaining goods to the buyer. The buyer is obliged to accept and pay for these goods.

Article 3

  1. Customer-specific goods will only be kept in stock after signing a separate agreement.
  2. The agreed stock level must be taken within 12 months. Upon termination of the agreement, the buyer must take the remaining stock within one month.
  3. Late collection entitles us to invoice unsold customer-specific stock. The buyer is obligated to settle the invoice regardless of any call-off or delivery.

Article 4

  1. In cases of force majeure, including late delivery by our suppliers, we reserve the right to postpone delivery or cancel the agreement. This also applies to temporary or permanent (e.g., end-of-lifecycle) unavailability of certain goods.
  2. We always aim to offer you a suitable alternative.

Article 5

  1. Our quoted price, excluding VAT, is valid until the day of delivery. For all orders, shipping and administrative costs are free for orders above €161.16 (excl. VAT). Below this order value, the shipping cost is €35 (excl. VAT).
  2. We reserve the right to increase our prices. For call-off and contract orders, we may pass on increases in import duties, taxes, or exchange rates to our prices unless otherwise agreed in writing.

Article 6

  1. We offer a wide range of shipping methods. If the buyer requests a specific shipping method that we do not offer as standard, the additional costs will be borne by the buyer.

Article 7

  1. All purchase agreements are subject to the condition that the buyer is sufficiently creditworthy. The goods sold remain our property until full payment is made.
  2. Due to the global shortage of PPE, we are compelled to require all customers to pay before we deliver products. Prepayment (cash-in-advance) is now also applicable for invoice payments.
  3. If the payment term is exceeded, the buyer owes an interest rate of 10% from the due date, as well as a flat compensation fee of 10% of the principal amount, with a minimum of €50.
  4. As long as the buyer has not settled the due and payable amount, we are entitled to suspend our obligations.
  5. The buyer is not entitled to suspend payment in whole or in part due to complaints or disputes.

Article 8

  1. Our responsibility ends upon acceptance of delivery by the buyer or their representative. Any complaints must be submitted in writing within 14 days of delivery. If a purchased item does not meet your expectations, you can report this within 14 days using the complaint form. Safety Workwear Shop may approve your return based on your reason.
  2. Returns of products (only unused products!) for which the buyer can be held liable must be made via our logistics partners. The cost is €10 + 5% of the value of returned products (for Belgium and the Netherlands) or €20 + 5% of the value (for Luxembourg, Germany, France, the UK, Spain, and Italy). Additionally, you will receive a voucher for the value of the returned products for your next order.
  3. If the customer can demonstrate within three days that an incorrect product was delivered (e.g., via photos and delivery slip), these unused products will be exchanged free of charge immediately. The customer will also receive a sincere apology from Safety Workwear Shop.

Article 9

  1. For disputes concerning sales contracts, only the court where our company is registered has jurisdiction. Thus, only the court in Antwerp, Belgium.
